It is hard to do justice, in a short reply, to Eyal's excellent review. Accordingly, I will focus on what I take to be its central claim – namely that I fail to give proper consideration to the extent to which the forced extraction of body parts undermines individuals' opportunities for self-respect. According to Eyal, ‘body exceptionalism’ can be defended on the following grounds: ‘People usually see trespass into a person and into objects they associate with a person – especially (...) into a person's body – as utterly disrespectful towards that person and her autonomy’. And later: ‘Whether or not organ confiscation is truly disrespectful. . . its widespread and intractable perception as a humiliating violation counts heavily against it, because it can thwart opportunities for self-respect’. On n'a jamais fini de lire une œuvre qui s'offre selon des points de vue, des perspectives, des niveaux et des résonances multiples. C'est pourquoi lire Rousseau exige que l'on pense avec lui et que l'on retrouve le rythme rarement calme d'une méditation qui, coïncidant avec sa vie, s'élève vers les plus hautes réquisitions critiques de la raison et, tout ensemble, se trouve rongée par un tourment métaphysique. Ce livre montre que si Rousseau, pour qui " tout tient radicalement à (...) la politique ", n'a cessé de disputer à Hobbes l'honneur d'avoir, ne premier, frayé le chemin de la " science politique ", c'est en philosophe - en philosophe profond - qu'il a ouvert cette voie. En effet, sa philosophie politique, qui est d'abord une réflexion sur les " institutions politiques " propres à l'Etat du contrat, se hausse, par une intuition critique encore innomée, jusqu'à l'horizon transcendantal où elle découvre l'idéalité pure de la normativité politique. Mais, dans l'élan d'une pensée réflexive que même les " extravagances " de ses rêveries n'ont pas arrêté, Rousseau, miné par l'angoisse d'exister, cisèle aussi une politique philosophique qui renvoie au mystère ontologique de l'homme condamné à l'errance que lui inflige son historicité. Dès lors, parce que l'ambivalence et les contradictions de la réalité socio-politique taraudent la pensée de Rousseau, celle-ci, déchirée, ne trouve sa cohésion et n'atteint son unité de sens que dans une médiation douloureuse sur l'homme écartelé, incapable d'assumer sa destination dans sa destinée. Jusqu'en ses promenades solitaires, le " subtil Diogène " a, tel un Sphinx, forgé l'énigme de l'homme en ses traits métaphysiques les plus profonds. (shrink)

"On ne cesse d'oublier d'aller jusqu'au fondement. On ne pose pas assez profond les points d'interrogation", écrivait Wittgenstein. L'oeuvre de Francis Jacques est une franche réplique à cette "remarque". Aussi occupe-t-elle une place originale dans la philosophie de notre temps. L'entreprise était audacieuse ; et elle devait être innovante. Les obstacles philosophiques étaient nombreux ; il fallait les reconnaître et les interroger jusqu'à leurs plus profondes racines. La démarche analytique, en l'occurrence, a fait merveille. Elle ne fut qu'un point de (...) départ. Mais il était décisif parce qu'il conduisait à bouleverser l'échiquier sur lequel la tradition des siècles avait construit ses systèmes philosophiques. Sur le chemin ainsi frayé, l'espace logique de l'interlocution a supplanté le subjectivisme-roi des philosophies de la conscience. L'exploration du dialogisme communicationnel a été la voie d'un questionnement approfondi qui, d'un point de vue métaphysique, a découvert la relation comme source originaire et fondationnelle de la pensée. À cette source pure puise l'exigence transcendantale qui, alliée aux structures formelles du travail de la pensée, commande l'érection du sens. En faisant du questionnement patiemment poursuivi l'activité génétique et critique de la pensée, l'interrogation radicale est devenue, en raison de sa portée ontologique, une élévation spirituelle. Aussi la sagesse peut-elle désormais défier les pathologies qui gangrènent les manifestations de l'existence. L'horizon s'éclaire de la lumière divine : il est un lieu de confiance et d'espérance. Au processus de "dé-construction" généralisée que développent aujourd'hui tant d'ouvrages, l'oeuvre de Francis Jacques oppose le mouvement d'une reconstruction spirituelle que commande, outre l'alliance hardie de la logique et de la métaphysique, l'écoute de la théologie. En fouillant les puissances originaires de l'interrogativité dont l'intégralité et la radicalité font la noblesse de la pensée, elle trace l'itinéraire au long duquel elle propose, contre la désespérance d'un temps de crise, de philosopher autrement pour retrouver les repères effacés et reconquérir, sur le chemin de l'Absolu, l'humanité perdue de l'homme. Si l'invention du sens moderne du mot Etat est due a Machiavel, c'est au XVIIIe siecle que, apres la paix d'Utrecht, l'institution etatique prit franchement le visage de la modernite. Faisant suite a l'Etat baroque (1610-1652) et a l'Etat classique (1652-1715), l'Etat moderne (1715-1848) donna corps aux espoirs de paix, de justice, de bonheur et de liberte secretes par la philosophie des lumieres. Il realisa les grandes mutations juridiques qui devaient contribuer a forger l'epure de l'Idee republicaine a laquelle la (...) Revolution de France donna sa premiere forme historique. Cet ouvrage s'est voulu pluridisciplinaire. En rassemblant des contributions dont la tonalite est historique, juridique, litteraire, philosophique ou politologique, il a pour objectif d'apporter sur la periode fascinante de l'histoire occidentale ou s'est affirme l'Etat moderne, des eclairages diversifies complementaires. In his review of my book Whose Body is It Anyway, Wilkinson criticises the view (which I defend) that confiscating live body parts for the sake of the needy is (under some circumstances) a requirement of justice. Wilkinson makes the following three points: (a) the confiscation thesis is problematic on its own terms; (b) there is a way to justify coercive resource transfers without being committed to it; (c) the thesis rests on a highly questionable approach to the status of (...) the body. Wilkinson’s paper is challenging, and some of his points are well taken. On the whole, however, it does not constitute an insurmountable challenge for my thesis. (shrink)

This work is haunted by an imminent contradiction. Starting from a declaration of Nietzsche’s political innocence, it nonetheless undertakes progressively and always more insistently to reveal the clarity of Nietzsche’s political wisdom. An entire emphasis is placed upon Nietzsche’s notion of the "philosopher as the doctor of civilization." This argument attains a dramatic if not historic pitch at p. 116, where Nietzsche’s immense superiority to other radicals is affirmed: "Ainsi, ni le révolutionnaire, ni le socialiste, ni l'anarchiste ne peuvent être (...) médecins de la civilisation…" Conceded: Goyard-Fabre distinguishes Nietzsche’s metaphysical politics from genuine pratique. Accordingly, "La pensée nietzschéenne ne se developpe nullement en politologie; elle n'est pas une philosophie pratique; ce n'est meme qu'en la transposant dans un registre qui n'est pas le sien que l'on croit lire en elle les thèmes d’une philosophie opérative." In lieu of an abstract, here is a brief excerpt of the content:BOOK REVIEWS353 Sainte Claire en Rouergue: viii centenaire de sainte Claire. Conférences du Colloque de Millau (29 septembre-3 octobre 1993). Ed. "Les amis de sainte Claire aujourd'hui." Millau: Maury, 1994. 220 pp. During the eighth centenary of the birth of St. Clare, many symposiums were planned in France: Millau, Béziers, Montpellier, Perpignan and Paris. Sainte Claire en Rouergue presents most of the conferences from the symposium of Millau, September (...) 29 to October 3, 1993. This symposium celebrated the Franciscan presence in the region of Rouergue, France, during the last eight hundred years as well as the history and spirituality of St. Clare. Although the presentations were focused on a clearer history of the Poor Clares, they provided much information about the First Order as well as the Third Order Franciscan women of the nineteenth and twentieth centuries. The book presented a clear overview of the Franciscan foundations, devastations, and their re-establishment after the French Revolution and the disappearance of many communities. The first section highlighted the person of Saint Clare and her historical moment. The various articles provided an interesting review of many different dimensions: of Ladies in history in the 11th to the 13th century (Pernoud), the new religious structure begun by Clare (Dejour), her spirituality (Fabre) and the living of the Gospel by Francis and Clare (Dutheil). The direction of the symposium was not only to the past glories of Clare, but examined her place in social communication today (Gritti) and gave practical suggestions so as to concretize her spirituality and her influence in the future of Franciscan life (Miniou, Mercadier, Ghirard). The second section of the book focused on the history of the Franciscan presence in southwestern France. Information was gathered from many sources about the various branches of Franciscan life in Rouergue: Friars Minor, Coletans, Capuchins, Recollects, Cordeliers, Cordelières, Damianites, Minorettes, and Urbanists. The symposium presented different backgrounds and aspects of Franciscan life in Rouergue using archives, iconography, descriptions of artifacts and images, charts and maps. A more detailed 354BOOK REVIEWS description of these various communities was given through the use of obituaries, personal and communal histories, photographs, and listing of dowries. The three Poor Clare communities of Rouergue were: Millau (founded in 1291); Granayrac-(1326-1677) moved to Villefranche-deRouergue (1677-1792); and Mur-de-Barrez (founded in 1653). Villefranche began as a rural contemplative monastery, but later moved to the city where they taught young girls and allowed elderly women to live with them. Through the stormy history of the Calvinist revolt and the French Revolution, the Poor Clare communities were dispersed more than once, but they are re-established in Millau and Mur-deBarrez today. Besides the political struggles, the Poor Clares of Millau had a long history of religious controversy and intrigue as well as glory. Presentations are also given on the Annunciationists, another branch of the Poor Clares founded by Jeanne of France and the Franciscan, Gabriel-Maria. These women came to Rodez in 1519. Third Order religious congregations were the first to return to Rouergue after the dispersion of the French Revolution. This paper argues that, if one thinks that the needy have a right to the material resources they need in order to lead decent lives, one must be committed, in some cases, to conferring on the sick a right that the healthy give them some of the body parts they need to lead such a life. I then assess two objections against that view, to wit: to confer on the sick a right to the live body parts of the healthy (...) violates the bodily integrity of the latter; and constitutes too much of an interference in their life. Dès l'aurore de la pensée, la recherche des raisons du droit a constitué une voie royale pour la philosophie juridique. Sur cette voie précisément, la raison s'est soumise à son auto-examen afin d'apurer sa propre démarche. La philosophie de Kant a, dans ce registre, donné ses lettres de créance à une critique de la raison juridique dont, malgré des divergences d'interprétation et des pluralismes parfois déroutants, l'héritage est, aujourd'hui encore, riche et vivace. Les chemins du criticisme juridique sont d'autant plus (...) escarpés qu'il existe des âges de la rationalité critique et que le philosophe, en s'engageant sur cet itinéraire, se lance dans une quête réflexive qui demeurera toujours inachevée. Il serait en effet présomptueux de croire que, même avec les nuances et les variances apportées par les philosophies contemporaines de l'argumentation et de la discussion, la philosophie critique de la raison juridique conduit à la fondation ultime et définitive des ordres de droit. On peut néanmoins reconnaître qu'elle jalonne la route au bout de laquelle brille, tel un phare, l'a priori transcendantal auquel s'accrochent le sens et la validité du droit. Dans la perspective que dessine la réflexion critique, la juridicité du droit se révèle donc comme le lieu d'excellence de l'Idéal régulateur de la raison. Given the fact that the history of our brain is a long history of interfaces, connections and exchanges, this text aims to reveal the collective nature of the process involved by and within learning. In fact, the person who learns can only cross-learn: irrespective of the field of learning, he learns across, between and beyond.2 The cross-disciplinary approach suggested in the present study focuses on learning a foreign language.

An adequate theory of rights ought to forbid the harming of animals to promote trivial interests of humans, as is often done in the animal-user industries. But what should the rights view say about situations in which harming some animals is necessary to prevent intolerable injustices to other animals? I develop an account of respectful treatment on which, under certain conditions, it’s justified to intentionally harm some individuals to prevent serious harm to others. This can be compatible with recognizing the (...) inherent value of the ones who are harmed. My theory has important implications for contemporary moral issues in nonhuman animal ethics, such as the development of cultured meat and animal research. (shrink)

Ccile Fabre examines the impact that arguments for distributive justice have on the rights we have over ourselves, and on such contentious issues as organ sales, prostitution, and surrogate motherhood.

In The Case for Animal Rights, Tom Regan argues that although all subjects-of-a-life have equal inherent value, there are often differences in the value of lives. According to Regan, lives that have the highest value are lives which have more possible sources of satisfaction. Regan claims that the highest source of satisfaction, which is available to only rational beings, is the satisfaction associated with thinking impartially about moral choices. Since rational beings can bring impartial reasons to bear on decision making, (...) Regan maintains that they have an additional possible source of satisfaction that nonrational beings do not have and, consequently, the lives of rational beings turn out to have greater value.. У статті проаналізовані досягнення Соціального Вчительства Католицької Церкви, репрезентовані працями Лева ХІІІ, Пія ХІ, Пія ХІІ, Івана Павла ІІ, що розкривають змістовні характеристики поняття «принцип субсидіарності», його роль і значення в системі християнських цінностей. Принцип субсидіарності робить можливими такі взаємовідносини в соціальному житті, коли спільнота вищого порядку не втручається у внутрішнє життя спільноти нижчого порядку, перебираючи на себе належні тій функції; заради спільного добра, спільного блага вона надає їй у разі потреби підтримку й допомогу, узгоджуючи у такий спосіб її (...) взаємодію з іншими соціальними структурами. Принцип субсидіарності скеровує соціальну практику на утвердження спільного блага в людському співтоваристві. Поширення і застосування принципу субсидіарності протистоїть небезпеці «одержавлення» суспільства та найзагрозливіших проявів колективізму, обмежує абсолютизацію влади, бюрократизацію державних і соціокультурних структур, стає одним із гарантів дотримання прав і свобод громадян своєї країни. According to the doxastic wrongs thesis, holding certain beliefs about others can be morally wrongful. Beliefs which take the form of stereotypes based on race and gender and which turn out to be false and are negatively valenced are prime candidates for the charge of doxastic wronging: it is no coincidence that most of the cases discussed in the literature involve false beliefs. My aim in this paper is to show that the thesis of doxastic wrongs does not turn on (...) the truth-value or valence of beliefs. (shrink)

Cécile Fabre draws back the curtain on the ethics of espionage and counterintelligence. In a book rich with historical examples she argues that spying is only justified to protect against ongoing violations of fundamental rights. Blackmail, bribery, mass surveillance, cyberespionage, treason, and other nefarious activities are considered.

Dans le cadre imposé par les nouvelles formes du capitalisme, de la marchandisation du savoir et des formes de vie, les concepts d'émancipation, d'aliénation et de reconnaissance retrouvent une nouvelle fonction critique. Cela ne signifie pas que l'on puisse faire un usage naïf et unilatéral de ces concepts, en les opposant simplement aux concepts issus du libéralisme, à commencer par le concept même de liberté. Loin des débats métaphysiques sur le libre-arbitre, ce livre, issu de travaux du séminaire de philosophie (...) de l'éducation du Centre de Recherche en Education de Nantes (CREN), travaille les problèmes actuels de l'éducation à l'aide d'outils intellectuels disponibles dans la tradition philosophique - qu'elle soit antique, moderne ou contemporaine - en les confrontant, au besoin, à des études historiques, sociologiques ou pédagogiques. Ce livre fournit dans sa première partie plusieurs instruments de travail autour de l'aliénation et de l'émancipation, et présente en seconde partie quelques-uns des problèmes que pose la reconnaissance de la liberté, comme but de l'éducation dans le contexte contemporain. Toutefois ces dernières ne sont pas des applications de positions théoriques défendues dans la première. Les contributions sélectionnées ont fait l'objet d'une discussion collective et ont été ensuite retravaillées par les auteurs. In his recent Rescuing Justice and Equality, G. A. Cohen mounts a sustained critique of coerced labour, against the background of a radical egalitarian conception of distributive justice. In this article, I argue that Cohenian egalitarians are committed to holding the talented under a moral duty to choose socially useful work for the sake of the less fortunate. As I also show, Cohen's arguments against coerced labour fail, particularly in the light of his commitment to coercive taxation. In the course (...) of defending those claims, I claim that Cohen's remarks on freedom of occupational choice and taxation exhibit partiality towards the interests of the better-off to the detriment of the less fortunate – a partiality which is in tension with his commitment to equality. Recent discussions in the just war literature suggest that soldiers have a duty to assume certain risks in order to protect the lives of all innocent civilians. I challenge this principle of risk by arguing that it is justified neither as a principle that guides the conduct of combat soldiers, nor as a principle that guides commanders in the US military. I demonstrate that the principle of risk fails on the first account because it requires soldiers both to violate their (...) strict duty of obedience and loyalty and to exceed their special obligations to protect their fellow comrades, the state, the state's constituents and other protected civilians. I then illustrate that the principle of risk fails on the second account since it conflicts with the commander's primary obligation to protect and promote the welfare and lives of his or her soldiers. I conclude by arguing that we cannot reasonably expect soldiers and commanders to adhere to the principle of risk until there is a radical, institutional-level transformation of militaristic goals, values, strategies, policies, warrior codes and expectations of service members in the US Armed Forces. This book articulates a cosmopolitan theory of the principles which ought to regulate belligerents' conduct in the aftermath of war. Throughout, it relies on the fundamental principle that all human beings, wherever they reside, have rights to the freedoms and resources which they need to lead a flourishing life, and that national and political borders are largely irrelevant to the conferral of those rights. With that principle in hand, the book provides a normative defence of restitutive and reparative justice, the (...) punishment of war criminals, the resort to transitional foreign administration as a means to govern war-torn territories, and the deployment of peacekeeping and occupation forces. It also outlines various reconciliatory and commemorative practices which might facilitate the emergence of trust amongst enemies and thereby improve prospects for peace. In response to commentators, we argue that whether waiving patent rights will meaningfully improve access to COVID-19 vaccines for low income and middle-income countries (LMICs), particularly in the short term, is an empirical matter. We also reject preferentially allocating vaccines to countries that hosted trials because doing so unethically favours those with research infrastructure, rather than those facing the worst burdens from COVID-19.

AI systems are bringing an augmentation of human capabilities to shape the world. They may also drag a replacement of human conscience in large chunks of life. AI systems can be designed to leave moral control in human hands, to obstruct or diminish that moral control, or even to prevent it, replacing human morality with pre-packaged or developed ‘solutions’ by the ‘intelligent’ machine itself. Artificial Intelligent systems (AIS) are increasingly being used in multiple applications and receiving more attention from the (...) public and private organisations. The purpose of this article is to offer a mapping of the technological architectures that support AIS, under the specific focus of the moral agency. Through a literature research and reflection process, the following areas are covered: a brief introduction and review of the literature on the topic of moral agency; an analysis using the BDI logic model (Bratman 1987); an elemental review of artificial ‘reasoning’ architectures in AIS; the influence of the data input and the data quality; AI systems’ positioning in decision support and decision making scenarios; and finally, some conclusions are offered about regarding the potential loss of moral control by humans due to AIS. This article contributes to the field of Ethics and Artificial Intelligence by providing a discussion for developers and researchers to understand how and under what circumstances the ‘human subject’ may, totally or partially, lose moral control and ownership over AI technologies. The topic is relevant because AIS often are not single machines but complex networks of machines that feed information and decisions into each other and to human operators. The detailed traceability of input-process-output at each node of the network is essential for it to remain within the field of moral agency. Moral agency is then at the basis of our system of legal responsibility, and social approval is unlikely to be obtained for entrusting important functions to complex systems under which no moral agency can be identified.
